Welcome to Prizee! These Terms of Service govern your use of the Prizee platform (web and mobile application) and related services. By using Prizee, you agree to these terms.
1. Eligibility
- You must be at least 18 years old to use Prizee. By creating an account, you confirm that you are 18 or older.
- You must provide accurate and complete information when creating your account, including your date of birth.
- You are responsible for maintaining the security of your account credentials.
- Prizee may require identity verification before you can participate in paid hunts or withdraw winnings.
2. How Prizee Works
Skill-Based Contests
Prizee is a location-based treasure hunt platform. Players compete by physically navigating to real-world locations using clues. Winners are determined entirely by skill (speed, navigation ability, puzzle-solving), not by chance.
How Winners Are Determined
Winners are determined by who physically reaches the treasure location first (live hunts), completes video challenges fastest, or achieves the highest score in skill-based challenges. No element of chance determines winners.
Prize Details
The prize type and value are shown on the hunt lobby before joining. Prize breakdown (1st place, 2nd place, etc.) is displayed so you know what you're competing for.
3. Prizes & Rewards
Free to Play
All hunts on Prizee are free to join. There are no entry fees. Prizes are funded by hunt creators and sponsors.
Prize Payouts
Prize winnings are credited to your Prizee wallet. Withdrawal to your bank account requires identity verification. Prizee is not responsible for delays caused by banking systems.
Tax Responsibility
You are solely responsible for reporting and paying any taxes on prizes received through Prizee, as required by your local tax authority.
4. Contest Rules
- All hunts on Prizee are free to join. No purchase is required to participate in any contest.
- Contests are open to users 18 years or older. It is your responsibility to ensure participation is legal in your location.
- Prizee or the hunt creator reserves the right to cancel any contest due to insufficient participants, suspected fraud, technical issues, or safety concerns.
- Any disputes regarding contest outcomes should be reported within 48 hours through in-app support. Prizee's determination of winners is final.
5. Fair Play & Rules
- Any form of GPS spoofing, location manipulation, or use of emulators to fake your position is strictly prohibited and will result in immediate account ban and forfeiture of prizes.
- Each person may only have one Prizee account. Creating multiple accounts to gain unfair advantages is prohibited.
- You may not post offensive, harmful, or inappropriate content in posts, reviews, or hunt descriptions.
- Always be aware of your surroundings while playing. Do not trespass on private property. Obey all traffic laws, signals, and posted signs at all times.
6. Assumption of Risk & Physical Activity
Voluntary Participation
You acknowledge that participation in Prizee treasure hunts involves physical activity in real-world outdoor environments. Your participation is entirely voluntary and at your own risk.
Assumption of Risk
By using Prizee, you expressly assume all risks associated with participating in treasure hunts, including but not limited to: bodily injury, physical harm, illness, death, property damage, emotional distress, and any other loss or damage that may result from your participation, whether caused by your own actions, the actions of other participants, third parties, environmental conditions, terrain, weather, traffic, wildlife, or any other cause.
Waiver of Claims
To the fullest extent permitted by law, you waive and release Prizee, its officers, directors, employees, agents, affiliates, hunt creators, and partners from any and all claims, demands, actions, causes of action, liabilities, damages, losses, costs, and expenses (including attorneys' fees) arising out of or relating to any injury, illness, death, or property damage that occurs during, or as a result of, your participation in any treasure hunt or use of the Prizee app.
Your Responsibility
You are solely responsible for your own safety and well-being while using Prizee. You agree to: assess your own physical fitness before participating; be aware of your surroundings at all times; obey all traffic laws, signs, and signals; not trespass on private property; not participate while impaired by drugs, alcohol, or fatigue; not use the app while driving or operating any vehicle; and use appropriate clothing, footwear, and equipment for outdoor activity.
No Safety Guarantee
Prizee does not inspect, verify, or guarantee the safety of any treasure hunt location. Hunt locations are set by creators and may include uneven terrain, public roads, waterways, or other potentially hazardous areas. Prizee makes no representations about the safety or suitability of any location.
Medical Conditions
If you have any medical condition, disability, or physical limitation that could be affected by physical activity, outdoor exposure, or walking/running, you should consult a physician before participating. You participate at your own risk regardless of any medical condition.
Indemnification
You agree to indemnify and hold harmless Prizee and its affiliates from any claims, damages, or expenses (including legal fees) arising from your participation in treasure hunts, your violation of these terms, or any injury or damage caused to yourself or others during gameplay.
7. Creator / Host Terms
- Creators must fund prizes before their hunt goes live. Unfunded hunts will not be activated. Creators are solely responsible for all prizes they offer.
- Creators must set treasure locations in safe, publicly accessible areas. Creators are liable for any injuries resulting from unsafe hunt locations they create.
- Creators are responsible for ensuring their hunts comply with all applicable local, state, and federal laws and regulations, including contest and sweepstakes laws.
- When using invite code entry, creators receive auto-generated codes to distribute. Creators are responsible for fair and lawful distribution of invite codes. Codes cannot be sold.
- Creators must fulfill all prizes they set. Prize details are shown on the hunt lobby. Payout schedule and conditions are shown in your creator dashboard.
- Fraudulent hunts or fake prizes will result in permanent account suspension, forfeiture of all earnings, and potential legal action.
8. Prohibited Activities
- GPS spoofing or location manipulation.
- Creating or joining hunts with multiple accounts.
- Using bots, scripts, or automated tools to interact with the platform.
- Attempting to reverse engineer, hack, or exploit the platform or its systems.
- Harassing, threatening, or abusing other users.
- Using the platform for money laundering or any illegal activities.
- Sharing or selling account access to others.
- Colluding with other players to manipulate contest outcomes.
9. Account Termination
- You may delete your account at any time through Settings. All your data will be permanently removed within 30 days.
- We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
- Upon termination for violations, any pending winnings may be forfeited.
10. Intellectual Property
The Prizee platform, brand, and all associated content are the property of Prizee and protected by copyright laws. Content you create (posts, hunt descriptions) remains yours, but you grant Prizee a non-exclusive license to display it within the platform.
11. Limitation of Liability
- Prizee is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee uninterrupted, error-free, or safe service.
- To the maximum extent permitted by law, Prizee shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to personal injury, death, property damage, lost profits, data loss, or emotional distress arising from your use of the platform, participation in treasure hunts, or reliance on any content or information provided through the platform.
- Without limiting the foregoing, Prizee is not responsible for injuries, accidents, illness, death, or any physical or emotional harm occurring during gameplay, travel to or from hunt locations, or any activity related to your participation in Prizee.
- In no event shall Prizee's total aggregate liability exceed the amount you have paid to Prizee in the preceding 12 months, or $100, whichever is less.
12. Governing Law & Disputes
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association rules, except where prohibited by law. You agree to waive any right to participate in a class action lawsuit against Prizee.
13. Apple Disclaimer
- This app is not sponsored, endorsed, or affiliated with Apple Inc.
- Apple is not responsible for any claims related to the app or its content.
- Any issues or support requests should be directed to Prizee, not Apple.
- Apple has no obligation to provide maintenance or support for this app.
14. Changes to Terms
We may update these terms from time to time. We will notify you of significant changes through the app or email. Continued use of Prizee after changes constitutes acceptance of the updated terms.
